동아시아의 사회보장 제도는 사회보험, 산업안전, 노동시간 규제를 노동자에게 전달하는 매개로서 ‘식별 가능한 고용주’를 전제로 설계되어 왔다. 그러나 플랫폼 노동은 이러한 전제를 근본적으로 흔든다. 플랫폼 노동자들은 형식적으로는 독립된 주체로 분류되지만, 실제로는 알고리즘 기반 업무 흐름에 종속되어 운영비와 위험을 감당하면서도 이에 상응하는 자율성과 보호를 갖지 못한다. 본 연구는 한국의 심야 배달 플랫폼 노동자를 대상으로, ‘허구적 자율성’이 과로와 어떻게 연관되는지, 그리고 그 관계에서 알고리즘 통제가 어떤 역할을 하는지를 분석한다. 다중 플랫폼에서 수집한 942명의 설문자료를 활용해 잠재계층분석을 실시한 결과, 계약상 독립성, 업무 재량, 비용 부담이 실제로 어떻게 결합되는지에 따라 세 가지 계층이 도출되었다. 이 중 가장 큰 비중(45.8%)을 차지하는 계층은 낮은 업무 자율성과 높은 비용 부담을 특징으로 하며, 허구적 자율성이 가장 뚜렷하게 나타나는 집단이다. 매개분석 결과, 알고리즘 통제는 이 집단과 과로 간의 연관성을 강화하며 전체 효과의 약 20%를 설명하는 것으로 나타났다. 반면 실질적 업무 재량을 유지한 노동자들은 알고리즘 압력을 상대적으로 견제했다. 이러한 결과는 고용주 중심의 복지국가 체계가 플랫폼 노동의 현실과 구조적으로 불일치함을 보여준다. 플랫폼이 고용관계를 은폐할 때, 과로 방지를 위해 설계된 규제 제도는 가장 보호가 필요한 노동자에게 도달하지 못하며, 이는 동아시아 사회보장 개혁에 중요한 함의를 제공한다.

Social protection systems in East Asia assume an identifiable employer mediates workers’ access to social insurance, occupational safety, and working hour regulation. Platform work upends this assumption. Workers are classified as independent yet remain subordinated to algorithmic workflows, bearing operating costs and risk without corresponding autonomy or protection. This study examines how fictitious autonomy relates to overwork among midnight delivery platform workers in South Korea, and the role algorithmic control plays in that relationship. Using original survey data from 942 workers across multiple platforms, latent class analysis identifies three classes that differ in how contractual independence, process discretion, and cost-bearing combine in practice. The largest class (45.8%), marked by minimal process autonomy alongside a high cost burden, most fully embodies fictitious autonomy. Mediation analysis shows that algorithmic control amplifies the link between this class and overwork, accounting for roughly 20% of the total association, while workers retaining substantive process autonomy resist algorithmic pressure. These findings expose a structural mismatch in employer-centred welfare states. When platforms obscure the employment relationship, regulatory institutions designed to prevent overwork fail to reach the workers who need them most, with implications for social protection reform across East Asia.
