본 연구는 프리랜서 예술인의 노동 특성과 실업 경험을 분석하여 예술인 고용보험과의 부정합성을 규명하는 데 목적이 있다. 특히 ‘예술인에게 실업이란 무엇인가’라는 근본적 질문에서 출발하여, 표준적 고용관계를 전제로 설계된 현행 고용보험 제도가 예술노동의 현실과 간극을 탐구하였다. 이를 위해 예술인고용보험 제도를 분석하고, 방송, 웹툰, 출판, 공연 등 4개 분야 12명의 프리랜서 예술인을 대상으로 심층 면접을 실시하였다. 연구 결과, 예술노동은 이질적인 보수체계, 불안정한 소득구조, 모호한 고용관계, 무급 창작노동과 유급노동의 혼재 등의 특징을 보였다. 예술인은 ‘소득 상실형 실업’, ‘일자리 상실형 실업’, ‘무급 노동의 지속’ 세 가지 유형의 실업 상태를 보였으며, 이는 고용보험 제도의 실업 개념으로 포착하기 어려운 것으로 분석되었다. 예술 노동 시장의 특성과 제도 부정합으로 인해 가입에서의 배제, 실업 인정 기준의 부적합성, 사업주 특정의 어려움 등에서 주요 부정합 지점이 도출되었다. 결국 예술인에게 실업의 의미는 창작 활동의 지속 가능성이 위협받는 상태로 이해되어야 하며, 이를 반영한 사회보장 체계 구축이 필요함을 주장하였다. 본 연구는 예술인 고용보험 제도의 정교화와 예술인의 노동권 보장을 위한 정책적 논의에 기여할 뿐만 아니라, 확대되는 비전형 노동자 대상 사회보장제의 과제에도 중요한 함의를 제공한다.
This study aims to analyze the characteristics of freelance artists’ labor and their unemployment experiences to identify mismatches with the current artists’ employment insurance system. Starting from the fundamental question “What does unemployment mean to artists?”, it explores how the current employment insurance system diverges from the realities of artistic labor. The study analyzed the insurance system’s content and conducted in-depth interviews with 12 freelance artists from four fields: broadcasting, visual arts, publishing, and performing arts. The results revealed that artistic labor is characterized by heterogeneous compensation structures, unstable income patterns, ambiguous employment relationships, and an overlap between creative and paid labor. Artists’ unemployment states were categorized into three types: ‘income loss unemployment’, ‘job loss unemployment’, and ‘continuation of unpaid labor’. Major points of mismatch included exclusion from insurance due to the lack of written contracts, difficulties in proving income reduction, and inadequacy of unemployment recognition criteria. In conclusion, this study argues that for artists, unemployment should be understood as a state where the sustainability of creative activities is threatened, and that a social security system reflecting this understanding needs to be established. This research provides important implications not only for artists’ labor rights but also for social security challenges facing non-standard workers.
